During the 2009 Regular Session of the Kentucky Legislature, KRS Chapter 324 was changed to clarify the law regarding the management of common interest communities. On June 25, 2009 the following new section of KRS 324 became effective:
KRS 324.2812 Limitation of the commission's (Kentucky Real Estate Commission) jurisdiction.
Nothing in this chapter or the administrative regulations promulgated under the authority of this chapter shall extend the jurisdiction of the Kentucky Real Estate Commission to community association managers and the management or business activities of not-for-profit community associations, which includes townhouse, condominium, homeowner, or neighborhood associations.
This change in the law the the result of the Final Order and Judgment of Jefferson Circuit Court-Eleventh Division; Case No: 07-CI-06866; KREC vs. CMA;
"IT IS ORDERED,ADJUDGED and DECLARED, that CMA is specifically allowed to provide management services to common interest communities such as neighborhood and homeowner associations or condominium and townhome communities without licensure through the KREC."
